Welcome to Vixmind. These Terms and Conditions govern your use of our website (vixmind.com) and the web design, local SEO, and website maintenance services we provide. By requesting a quote, signing a proposal, or purchasing our services, you agree to be bound by the terms outlined below.

1. Our Services

Vixmind specializes in custom website design, local SEO, and ongoing website care plans engineered for service-based businesses. The specific scope of work, deliverables, timelines, and pricing for your project will be detailed in your individual project proposal or invoice.

2. Client Responsibilities

To ensure your project stays on schedule and meets our quality standards, you agree to:

  • Provide all necessary materials (logos, brand guidelines, images, and specific text) in a timely manner.
  • Grant us necessary access to existing hosting accounts, domain registrars, or third-party platforms required to complete the work.
  • Respond to revision requests and approvals promptly. Significant delays in client feedback may result in timeline extensions.

3. Payment Terms

  • Project Payments: Web design and SEO projects typically require an upfront deposit before work commences, with the remaining balance due upon project completion or at agreed-upon milestones.
  • Maintenance Plans: Website Care Plans (Complete Website Care) is billed on a recurring monthly basis.
  • Late Payments: We reserve the right to pause work or suspend website hosting/maintenance services if invoice payments are severely delayed.

4. Revisions and Approvals

Custom web design packages include a set number of revision rounds, which will be clearly stated in your project proposal. Once a design or page is formally approved, any major structural changes or complete redesigns may incur additional hourly fees.

5. Ownership & Intellectual Property

We believe in full transparency, there are no hostage situations with your digital assets.

  • Your Ownership: Upon receipt of full final payment, you retain 100% ownership of the final website design, graphics, and content created specifically for your project.
  • Our Rights: Vixmind retains the right to showcase the completed website, design assets, and performance metrics in our agency portfolio, social media, and marketing materials, unless a strict Non-Disclosure Agreement (NDA) is signed prior to the project starting.

6. Website Maintenance & Care Plans

If you are enrolled in one of our monthly Website Care Plans:

  • Coverage: We provide continuous monitoring, security updates, daily cloud backups, and allocated time for minor content edits based on your chosen tier.
  • Cancellations: There are no long-term contracts. You may upgrade, downgrade, or cancel your maintenance plan at any time with a 15-day written notice prior to your next billing cycle.
  • Limitations: Maintenance hours do not roll over to the next month. “Small monthly edits” cover text changes, image swaps, or basic contact updates, not the development of completely new pages or extensive structural redesigns.

7. SEO & Search Ranking Disclaimer

While we employ industry-leading local SEO strategies, Schema markup, and performance optimization to maximize your visibility, search engines (like Google) frequently update their algorithms. Therefore, Vixmind cannot guarantee specific search engine rankings, exact traffic volumes, or a specific number of inbound phone calls.

8. Limitation of Liability

Vixmind will not be held liable for any lost profits, lost leads, or business interruptions resulting from circumstances beyond our control. This includes server downtime, third-party plugin failures, malicious hacking attempts (though our maintenance plans actively work to prevent this), or issues arising from unauthorized changes made to the website by the client.

9. Third-Party Tools

Your website may utilize third-party services (e.g., Hostinger, WordPress plugins, CRM integrations, Apple Business Connect, Bing Places). We are not responsible for the terms, policy changes, or price increases of these external software providers.

10. Changes to These Terms

We reserve the right to modify or update these Terms and Conditions at any time. Any changes will be posted directly to this page with an updated “Effective Date.” Continued use of our services after any changes indicates your acceptance of the new terms.
